Offered here is an original hand-engrossed Victorian mortgage indenture on vellum/parchment, dated 6th July 1868, recording a Mortgage of Two Dwelling Houses, Land, and Hereditaments in Dursley Lane, Trowbridge, Wiltshire, granted by Mr. Samuel Mortimer, Clothworker, of Trowbridge, to Mr. John Seargent, Gentleman, of the same place, to secure the principal sum of £80 and interest.
Document Overview
Samuel Mortimer mortgages to John Seargent two tenements or dwelling houses with their gardens situated at Middle Studley in the Parish of Trowbridge in the County of Wiltshire, containing by admeasurement one rood and twenty perches (more or less). The premises are bounded on the north by land of George Dainton, on the west by land formerly of Edward Horlock Mortimer Esquire, on the east by the road leading from Dursley to Trowbridge, and on the south by property formerly belonging to John Applegate. The dwelling houses and gardens are now in the respective occupations of the said Samuel Mortimer and Edward Lucas. The document conveys together with all houses, buildings, ways, paths, passages, waters, watercourses, hedges, fences, ditches, and all other appurtenances.
The mortgage terms provide for repayment of £80 with interest at five pounds per cent per annum, payable by equal half-yearly payments on the sixth day of July and the sixth day of January in each year. The standard Victorian mortgage provisions are present in full: a Proviso for Redemption on repayment of principal and interest without deduction, a covenant by Mortimer that the premises are free from incumbrances, a covenant to keep the premises insured against fire damage, a Power of Sale exercisable after default and six months’ notice in writing, a declaration that the receipt of purchase monies shall effectually discharge purchasers, and a direction for application of sale proceeds first to costs, then to satisfaction of the mortgage debt and arrears of interest, with any surplus payable to Samuel Mortimer. The Provided Nevertheless clause protects Seargent’s executors administrators and assigns from liability for involuntary losses in the exercise of the power of sale.
A receipt is endorsed on the document confirming receipt by Samuel Mortimer of £80 consideration money, signed by Samuel Mortimer and witnessed by G.B. Rodway.
